1. On the basis of Art. 6 sec. 1a of the GDPR Regulation 2016/679, I hereby consent to the processing by BNY Mellon (Poland) Sp. z o.o. with registered seat in Wrocław (hereinafter: “the Controller”) of my personal data including: name and surname, job position and image (“Personal Data”), including in form of photographs and films in which I have participated, for the purposes related to the marketing of the Controller’s services and for promotional and advertising purposes regarding the Controller’s activity (including the Controller’s activity as an employer), i.e.:
– to placing of my Personal Data on the BNY group’s Intranet q YES q NO
– to placing of my Personal Data on the Controller’s website q YES q NO
– to placing of my Personal Data on the Controllers’ accounts on social
media (for example Facebook, LinkedIn) q YES q NO
– to placing of my Personal Data in other marketing materials of the
Controller, issued in paper or electronic form (inter alia in folders and
prospectuses, publications regarding own works, collective publications) q YES q NO
2. I have been informed, that:
a. BNY Mellon (Poland) Sp. z o.o. with registered seat in Wrocław (50-088) at 3 Swobodna Street is the controller of my Personal Data,
b. A Data Protection Officer has been appointed for the companies in the BNY Mellon group, with whom I can contact under the following e-mail address: trmglobalprivacy@bnymellon.com,
c. I have the right to:
· demand from the Controller access to my Personal Data, their rectification, erasure or restriction of processing or to object to the processing, as well as to data portability (whereas these rights might be subject to limitations set out in the provisions of the applicable laws, in particular in the GDPR Regulation, 679/2016),
· lodge a complaint with the President of the Office for Personal Data Protection,
· withdraw this consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal,
d. the recipients of my Personal Data may be the following:
· persons, to whom the marketing materials including my Personal Data are addressed,
· other entities in the BNY group,
· other entities providing services for the Controller in the scope of marketing, in particular creation of websites,
· administrators of the social media, on which the Personal Data are placed, inter alia Facebook Ireland Ltd., LinkedIn Ireland Unlimited Company.
e. The Personal Data can be transferred to third countries, including countries which do not ensure an adequate level of protection. In such case, personal data is transferred to entities which are obliged to ensure an adequate level of protection of personal data, for example by using standard data protection clauses accepted by the European Commission1.
f. Personal Data may be processed on the basis of this consent for the period of employment by the Controller and for 6 months after termination of employment, and in case of persons who are not employees of the Controller for the period of 5 years, unless the consent is earlier revoked or another period of Personal Data processing shall be determined. g. To exercise my rights I can send an e-mail to the following address: trmglobalprivacy@bnymellon.com or I can file a writ to the Controller’s address.
3. Based on Article. 81 par. 1 of the Copyright and Related Rights Act, I consent to the dissemination of my image by the Controller for the purposes and in the manner described in point 1 and 2 above. Consent to the use of the image is provided free of charge.
4. The processing of my Personal Data and the use of my image by the Controller includes in particular recording, dissemination and publication on websites, in folders and prospectuses, publications concerning own works, collective publications and for promotional and advertising purposes of the Controller, on the website of the Controller, at any time and place, as well as erasure of the Personal Data and/or image.
